LEGAL SUFFICIENCY OF PARTISAN RECALL EFFORT IN SENATE DISTRICT 6 CHALLENGED IN DISTRICT COURT

Las Vegas, NV – The Nevada Senate Democratic Caucus today issued the following statement from attorney Bradley Schrager of Wolf Rifkin on the filing of a lawsuit challenging the legal sufficiency of the recall petition against Nevada State Senator Nicole Cannizzaro (District 6):

“Much as in Senate District 5 against Senator Joyce Woodhouse, extensive review of the petitions and signature removal forms has found that Republicans are far below the necessary signature threshold, and that they will not be able to surmount the deficit. We are eager to present our challenge in district court, and have high confidence that the court will halt this abuse of Nevada’s recall laws in its tracks.”

Republicans needed a minimum of 14,975 eligible signatures to force the recall forward, but fewer than 13,000 signers appear to be eligible.

If the court determines that the recall petition is not sufficient, it will order Clark County to cease further action regarding the petition. Extensive documentation and affidavits have been submitted in support of the legal challenge.

In District 6, Republicans needed hundreds more signatures than in District 5, and wound up turning in many fewer than in the Woodhouse effort. The margin for their error is therefore much smaller for the Cannizzaro recall effort, and they appear to have done no better in collecting valid signatures or in convincing district voters not to remove their names from the petition.

Nearly 1,700 recall petition signers were found to be constitutionally or statutorily ineligible due to petition signing requirements. Furthermore, more than 2,200 Nevadans have asked the Secretary of State or the Clark County Registrar to strike their name from the recall petition—several hundred more than the difference between what the Republicans needed (14,975) and what they submitted (16,875).

“In the end, despite their efforts, Republicans have failed to convince enough voters in District 6 to go along with their partisan recall scheme,” Schrager said. “The end of this cynical chapter in Nevada politics is near.”
