Senate Bill 2 would make an appropriation to the State Distributive School Account to ensure that the amount of money expended per pupil in Nevada K-12 for the 2009-2011 biennium meets or exceeds the national average. The Nevada Plan will make sure that each student has an opportunity to receive a quality education, with financial assistance from both state and local governments.

Hybrid Taxicabs- SB 9

Existing law provides that a vehicle may be operated as a taxicab for 67 months if acquired as a new vehivle or for 55 months if acquaired as a used vehicle registering not more than 30,000 miles on the odometer.  This legislation would all for a hybrid vehicle to be operated as a taxicab for an additional 24 months beyond the existing limits, encouraging the use of more hybrid taxicabs on our streets.

Local Government Reform- SB11

Prohibits the county commissioners of certain larger counties from holding certain other employment

Senate Bill 11 would require a member of the board of county commissioners of a county whose population is greater than 400,000—currently only Clark County—to hold the Commission position as an exclusive full time job.  The legislation exempts temporary and part-time teaching duties on a university campus.  As many advocates have pointed out, a full-time commission would have more time to meet with the public and learn about issues on their own, instead of relying on staff for information about county issues, Care said.

Since the Hepatitis scare, it is time Nevada enforce more inspections at medical facilities. Existing law requires certain medical facilities, including hospitals, psychiatric hospitals, community triage centers and surgical centers for ambulatory patients, to be licensed by the Health Division of the Dept. of Health and Human Services.

This bill require offices of physicians or other facilities providing health care that are not licensed as a medical facility by the Health Division to obtain a permit from the Division before offering to patients services of general anesthesia, conscious sedation or deep sedation and prescribe the procedure for obtaining such a permit. This bill also requires the Health Division to conduct annual, unannounced inspections of those offices and facilities.

Cracking Down on Drunk Driving- SB 100
Revises the provisions governing the period of revocation of a driver's license upon conviction of certain offenses involving driving under the influence

Under existing law, the driver's license of a person convicted of driving under the influence is revoked for a certain period depending upon whether the violation is punishable as a first, second or third or subsequent violtation that occurs within a period of seven years.  This legislation provides that the period of revocations of the driver's license of such a person must be based upon the total number of previous violations within a period of 7 years, regardless of how the violation is treated for sentencing purposes.

The second subcommittee that is created within this bill is the Subcommittee on Victims of Crime.

Advancements in Energy Efficiency- SB114
Makes various changes relating to systems for obtaining and using solar energy and other renewable energy resources

Existing law sets forth a prohibition against covenants, restrictions or conditions contained in deeds, contracts or other legal documents which prohibit or unreasonably restrict an owner of property from using a system for obtaining solar or wind energy on his property.

This bill includes within the prohibition any such covenant, restriction or condition which has the effect of prohibiting or unreasonably restricting the property owner from using such a system. The Bill goes on to describe what an unreasonable restriction includes. It appoints the Director to make determinations concerning the efficiency or performance of a system for obtaining solar or wind energy.

Light Rail- SB115
Requires certain governmental entities to work cooperatively to establish the Henderson to North Las Vegas Fixed Guideway Corridor

This bill requires Clark County, the Cities of Henderson, Las Vegas and North Las Vegas and the Department of Transportation to work cooperatively to establish the Henderson to North Las Vegas Fixed Guideway Corridor, a fixed guideway to be constructed beginning at Nevada State College in the City of Henderson and running through the City of Henderson, a portion of the unincorporated area of Clark County, the City of Las Vegas and the City of North Las Vegas, and ending at the North Las Vegas regional campus of the University of Nevada, Las Vegas. High speed rail lines that have been built around the country have given jobs to thousands of people and served millions of travelers, all while saving energy.

Increased Property Tax Assistance for Seniors- SB122

Existing law authorizes a senior citizen who is at least 62 years of age and whose household income does not exceed a certain amount to receive a refund of all or a portion of the property tax accrued against his home. If the senior citizen owns his home, the amount of the refund must not exceed the amount of the accrued property tax or $500, whichever is less.  
 This bill increases the maximum refund for such a senior citizen to the amount of the accrued property tax or $1,000, whichever is less.

Foreclosure Sales- SB 128

Requires certain persons to record foreclosure sales and sales of real property under a deed of trust within a certain period of time

Nevada has the highest foreclosure rate in the country and we can no longer afford to let those numbers increase. Senator Parks is taking steps to solve this problem. Penalties in Highway Contruction Zones- SB134
Revises provisions concerning the increased penalty imposed for certain traffic violations occurring in work zones

Existing law requires the doubling of the penalty imposed against a person convicted of speeding or convicted of certain other traffic offenses that occur in a highway construction zone if: (1) workers are present; or (2) the effects of the offense are otherwise aggravated because of certain highway conditions that exist as a result of the highway construction.
This bill maintains the double penalty if such an offense occurs in a highway construction zone when workers are present. However, this bill provides that a court may, but is not required to, impose a reduced additional penalty of not more than one-half the penalty imposed for the primary offense if the offense occurs in a highway construction zone when workers are not present but where the effects of the offense are still otherwise aggravated because of certain highway conditions that exist as a result of the highway construction.

Making Nevada's Roads Safer- SB136
Prohibits certain persons from using a telephonic device to write, send or read a text-based communication while operating a motor vehicle

This bill prohibits a person from using a telephonic device to write, send or read a text-based communication while operating a motor vehicle except in certain circumstances. A person who violates this provision must pay a fine of $20 for a first offense and a fine of $50 for a second or subsequent offense. This bill does not create a moving violation.

Making the Roads Safer for Passengers- SB145

This bill removes the provision of existing law which prohibits the issuance of a citation for failure to wear a safety belt in a passenger car or taxicab unless such vehicle is stopped or the person is arrested for another offense. By removing this provision, the bill allows the issuance of a citation for such a violation even absent any other conduct (that is, as a “primary offense”).

This bill also makes it a violation of law for the driver of a taxicab to fail to ensure that a child passenger is wearing a safety belt, provided that the child is of such a size and weight as to be required to wear a safety belt.

Existing law authorizes the Board of Regents of the University of Nevada to charge tuition to students who are not bona fide residents of Nevada and to charge certain fees to students who are bona fide residents. Existing law also authorizes the Board of Regents to waive certain fees for a member of the Nevada National Guard or a recruit for the Nevada National Guard.
This bill expands the waiver of fees for a member of a reserve component of the Armed Forces of the United States. This bill also authorizes the waiver of certain fees and tuition for a widow, widower or dependent child of a person who is killed while serving in the Nevada National Guard.This bill also authorizes the waiver of tuition for a dependent child of a person who sustained a permanent partial disability while serving in the Armed Forces of the United States.

Non-Profits to Submit Financial Reports to State- SB153

Existing law regulates the activities of nonprofit corporations within the State. This bill requires every charitable corporation that intends to solicit contributions in this State to file a registration statement and financial report with the Secretary of State. The registration statement must include certain basic information about the charitable corporation. The registration statement and financial statement must be filed annually. This bill also requires the Secretary of State to publish certain information provided by a charitable corporation on the Secretary of State’s Internet website.

Cancer Drug Donation Plan- SB 159

This bill requires the State Board of Pharmacy to establish the Cancer Drug Donation Program. The Program will distribute and dispense cancer drugs donated to the Program to cancer patients. It also authorizes persons to donate cancer drugs at any pharmacy, medical facility, health clinic or provider of health care that participates in the Program. The donated drugs must be in the original, unopened and sealed packages and must not be adulterated or misbranded. Part of the bill provides immunity from civil liability for damages caused by any act or omission of a person who donates a cancer drug to the Program, or who accepts, distributes or dispenses a cancer drug donated to the Program.

Voting in Local Government- SB 224

Senate Bill 224 eliminates a loophole in the law that allows members of local government to abstain from votes that come before that body. This bill applies to counties whose population is 40,000 or more (currently Clark, Washoe, Elko and Douglas Counties and Carson City). Thus, in those larger counties, this bill removes the ability of a public body which is required to be composed entirely of elected officials to take action by a vote of less than a majority of all the members of the body.

Senate Bill 283 would establish a domestic partnership as a new type of civil contract recognized in the State of Nevada. Under the provisions of this bill, domestic partners have the same rights, protections, benefits, responsibilities, obligations, and duties as do parties to any other civil contract. Some of the benefits for domestic partners would include hospital and jail visitation rights which are now reserved for family members; rights involving wills, inheritance and trusts; and the ability to make health care and funeral decisions for each other.

Revising OSHA- SB 288

Revises provisions relating to occupational safety and health

Across the state, citizens are becoming highly concerned that Nevada Occupational Safety and Health Administration (OSHA) has not been effectively enforcing state workplace safety laws. That is why Sen. Maggie Carlton introduced Senate Bill 288. This legislation would remove OSHA from the Department of Business and Industry and make the Board responsible for the enforcement of work safety and health laws. The bill would also require employees and contractors to complete occupational safety and health training.

Nevada's Medicaid Program- SB 307

Nevada Medicaid provides insurance for the most vulnerable of Nevada’s citizens. Senator Wiener decided it was about time a study was conducted to look at the state’s Medicaid funds to determine the long-term financial sustainability of the program. That is why she introduced Senate Bill 307, which, if it passes, would launch an intensive study of Nevada’s Medicaid system. The study will determine how Nevada can sustain the Medicaid program both in healthy and challenging times. It will also look at the rates that Medicaid charges in Nevada versus other states.

Preparing Students to be Financially Responsible- SB 317

During this tough economic time that Nevada is facing, it is crucial to make sure that we are teaching our students to practice financial responsibility to guarantee that their generation is better prepared to deal with economic hardships. That is why State Senator Allison Copening (Dist. 6), has proposed Senate Bill 317, which would require the Department of Education to ensure that instruction in financial literacy is provided to pupils enrolled in a public high school in Nevada. A pupil must demonstrate satisfactory completion of the instruction by passing a test before he/she receives a diploma.

NV Students Deserve a World Class Education- SB 330

He also believes Nevada’s education system should adequately prepare students for a future in higher education or the workforce.

Renewable Energy in NV- SB 358

Senate Bill 358 would revise provisions relating to energy and state and residential property. This bill would require a portion of the federal stimulus money to be used for the state energy reduction plan for state buildings. This bill will also require the Director of the Office of Energy to adopt regulations establishing a list of renewable energy installations and energy efficiency improvements that are suitable for residential property.
